LipaBoma – Terms of Service
Effective Date: 1st November 2025
1. Introduction
These Terms & Conditions ("Terms") govern the use of the LipaBoma platform ("Service"), owned and operated by Helium Technologies Limited. By accessing the website, dashboards, or mobile interfaces, you agree to these Terms.
If you disagree with any part, do not use the platform.
2. Definitions
- User: Any individual or organization using the platform
- Landlord/Owner: Property owner receiving rent
- Tenant: Occupant of a rental unit
- Manager/Agent: Administrator handling units on behalf of owners
- Wallet: Digital balance within LipaBoma
- Payment Processor: M-Pesa, bank, or any Helium Technologies Limited partner
3. Eligibility
You must be:
- At least 18 years old
- Legally capable of entering contracts
- Providing accurate information
4. User Accounts
You agree to:
- Provide truthful information
- Maintain confidentiality of your password
- Not misuse another user's account
Helium Technologies Limited may suspend or terminate accounts for fraud, violation of laws, or breach of Terms.
5. Platform Features
5.1 Property Management Tools
- Unit listings
- Tenant onboarding
- Lease setup
- Document storage
- Maintenance tracking
5.2 Payment Processing
LipaBoma supports:
- M-Pesa payments
- Bank transfers
- Wallet-to-bank withdrawals
Helium Technologies Limited does not control third-party payment delays.
5.3 Wallet Provision
Owners receive a LipaBoma Wallet for rent proceeds.
You agree that:
- Withdrawals may take up to the published settlement period
- Incorrect bank details are your responsibility
- Platform fees may be deducted prior to payout
6. Fees
Helium Technologies Limited may charge:
- Transaction fees
- Service subscription fees
- Withdrawal fees
- Penalties for chargebacks or reversed payments
Fees will always be disclosed in the platform or agreements.
7. User Conduct
Users must not:
- Engage in fraud
- Upload illegal content
- Harass other users
- Attempt unauthorized system access
- Reverse engineer the platform
- Use LipaBoma for money laundering or unlawful activity
8. Data Protection
Helium Technologies Limited will process all personal data in accordance with:
- Kenya Data Protection Act
- East African regulations
- Our Privacy Policy
9. Intellectual Property
All content, branding, software, logos, and designs of LipaBoma belong exclusively to Helium Technologies Limited. Users are granted a non-exclusive, revocable license to access and use the platform.
10. Liability Limitations
Helium Technologies Limited is not liable for:
- Losses caused by incorrect user information
- Payment delays caused by M-Pesa or banks
- Property disputes between landlords and tenants
- Loss of income due to service downtime
- Unauthorized access resulting from user negligence
- Third-party integrations
Maximum liability shall not exceed the total fees paid in the previous 3 months.
11. Dispute Resolution
Disputes shall be resolved as follows:
- Internal mediation by Helium Technologies Limited
- If unresolved, arbitration in Nairobi, Kenya
Governing law: Laws of Kenya
12. Account Termination
Helium Technologies Limited may suspend or terminate accounts for:
- Fraud
- Violation of Terms
- Abuse
- Non-payment
- Legal requests
Users may delete accounts anytime, but prior transactions remain recorded.
13. Third-Party Services
Use of payment processors or integrations is subject to their own terms.
14. Changes to Terms
We may update these Terms anytime. Continued use means you accept the changes.
